TERMS AND CONDITIONS ELEONORE DE RUUK
Trading terms
These are the terms and conditions of Eleonore de Ruuk, located in Amsterdam, The Netherlands and registered in the Trade Register of the Chamber of Commerce Amsterdam under number 34254694.
These terms and conditions apply to all purchase-orders for goods from the Eleonore de Ruuk webshop.
By placing an order you accept:
-that these terms and conditions apply,
-that you are an authorised user of the credit or debit card used to make your purchase
-and that there are sufficient funds to cover the cost of the ordered goods.
It is your responsibility to inform us of any changes to these details as soon as possible. This does not affect your statutory rights as a consumer.
These terms and conditions are governed by the laws of the Netherlands and all claims and disputes between Eleonore de Ruuk and the purchaser will exclusively be brought before and settled by the competent court in Amsterdam, the Netherlands although Eleonore de Ruuk reserves the right to bring a claim before any other court.
Eleonore de Ruuk reserves the right to alter these terms and conditions without notice from time to time.
Intellectual property
The logo Eleonore de Ruuk and the Eleonore de Ruuk webshop is the property of Eleonore de Ruuk.
www.eleonorederuuk.com and the design and all of the materials on this website are protected by international copyright laws. Eleonore de Ruuk will enforce its intellectual property rights to the fullest extent of the law.
All product and company names, trademarks and logos are the property of their respective owners. No copy, reproduction, modification, distribution or display of any part of this site or products allowed without prior written permission.
By all of the materials we mean HTML codes, scripts, texts, artwork, photographs, images, designs and other materials that appear as part of this website are protected by Dutch copyright laws and other Dutch and international laws and treaties.
You may not copy, reproduce, publish, transmit, distribute, perform, display, post, modify, create derivative works from, sell, license or otherwise exploit this website or any of the Content and you may not access or use the website for any competitive or commercial purpose.
Any unauthorized copying, alteration, distribution, transmission, performance, display, or other use of the Content is prohibited.
Privacy
Eleonore de Ruuk respects your privacy. Therefore the information you provide us through the website will only be used to process your order and to inform you on Eleonore de Ruuk and its designs. Eleonore de Ruuk holds the right to save and process all customer information necessary for the purposes of performing the placed order. Your personal data will not be made available to any third parties unless, on the ground of a legal provision or an enforceable judgement, Eleonore de Ruuk is obliged to provide such information to third parties as determined by law or the judgement. You have the right to access and/or correct your personal data at anytime.
Prices
All prices are VAT inclusive but don’t include shipping costs and insurance.
Eleonore de Ruuk reserves the right to amend prices on the site at any time.
The currencies (Euro, American Dollar, British Pound) given when browsing the catalogue are given as an indication only . Exchange rates are updated continuously, therefore local prices may vary from time to time. The default currency is the Euro and all purchase must be paid in Euro inclusive of VAT and costs (as applicable).
Your credit card company may use a different exchange rate to us, therefore the price you pay in your currency may vary. All costs of currency conversion are for your account and are to be charged to you.
Payment
Orders will only be shipped after Eleonore de Ruuk has received the complete payment.
You can pay for the order by using one of the following payment methods:
- Credit card (Visa, MasterCard and American Express)
- Bank transfer; In this case the full amount should be transferred within 7 working days after the date of the order into Postbank account number 6645693 (IBAN: NL97PSTB0006645693, BIC: PSTBNL21) in the name of E A de Ruuk Amsterdam, mentioning the invoice number and the date of the order. During this period the ordered goods will be reserved for you. If full payment is not received within this period the items will be released for selling to other customers.
After receiving the full payment Eleonore de Ruuk will send a confirmation by e-mail.
If you pay by credit card (number) you confirm that the credit card that is being used is yours.
Eleonore de Ruuk takes security very seriously.
All credit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of the payment card refuses to authorise payment to Eleonore de Ruuk, delivery of the items will be postponed and Eleonore de Ruuk will contact you. Eleonore de Ruuk shall not be liable for any delay or non-delivery.
Delivery
Ordered items will be shipped within 3 days. You will receive a confirmation by e-mail as soon as your order has been shipped.
Eleonore de Ruuk will do its best to deliver all items within the periods as indicated on the website. However, for delivery Eleonore de Ruuk is dependent on its couriers. Therefore the delivery periods are indicative only and are not binding Eleonore de Ruuk.
Eleonore de Ruuk cannot be held responsible for items lost or damaged once despatched and is not responsible for any delay in delivery due to postal delays, strikes or forces otherwise beyond its control.
When the goods are insured the risk in the items shall pass from Eleonore de Ruuk to the addressee upon delivery. You are required to fully inspect the delivered items within 7 working days after delivery. In case of any alleged incompleteness or defect you must give written notice to Eleonore de Ruuk by sending an e-mail to info@eleonorederuuk.com within this period of 7 working days after which no claims for deficiency or incompleteness will be accepted.
The customer is responsible for paying the estimated shipping and insurance costs. The shipping cost will vary according to weight and delivery destination of the ordered items and will be calculated through the buying process.
Be sure we look for the most reliable solution for the shipment of your order and that we make no profit on postage costs.
International orders are subject to the custom fees charged by the destination’s government. Eleonore de Ruuk has no control or responsibility over any charges that may be applied by the destination country, like customs and import duties or sales tax.
If you are sending a gift and would like to attach a personal message, please let us know when ordering.
Returns and exchanges
We want you to be completely satisfied with your purchase. However, if for any reason you are unhappy with your goods, we will gladly accept them back and offer you an exchange or a full refund, minus postage charges paid.
Customers with items deemed to be faulty will have postage costs refunded.
A product may be exchanged or reimbursed if it is sent back without any damage, without having been worn, in its original packaging and garment tags still attached after cancellation within seven working days upon delivery. We review each return individually, and will not refund for items if the hangtag is missing, if the item has clearly been worn or damaged, or if a different refund policy has been stated on the item page.
Cancellation must take place by means of sending an e-mail to shop@eleonorederuuk.com prior to shipment and stating the invoice number and the reason for return.
Returns or exchanges made without prior notification will not be processed.
In case the returned items are not in the perfect condition they were sent, the items will be sent back to you and the agreement between you and Eleonore de Ruuk will not have been terminated.
Returned items must be identified by enclosing the original invoice.
The return is at the responsibility and expense of the customer, unless we have delivered incorrect items. We recommend that you send the goods using a delivery service that insures you for the value of the goods. Please remember to ask the Post Office for your proof of posting certificate and retain it for your reference.
Re-delivery costs will have to be charged again, to the same card you used to make the original purchase. Postal charges will always be advised to you before we proceed.
Your refund will be credited in the same manner and to the same account used to make the original purchase.
After the aforementioned period of 7 days, the products will be considered as in compliance with your order thus as accepted by you.
Size exchanges are subject to stock availability. Please clarify any doubts about sizing before ordering by referring to the size guide or by e-mailing us.
Eleonore de Ruuk does not accept returns on items that were not purchased through the website.
